ENA PELLY x PAY.COM.AU COMPETITION

1. The promoter of this promotion is Pay.com.au Limited (ABN 75 639 316 546), 207/28 Riddell Parade, Elsternwick, VIC, 3185 and Ena Pelly, W5, 33 Mackey Street, North Geelong, VIC, 3215.

2. Entry is free and open to Australian residents (excluding South Australia, Northern Territory and Australian Capital Territory residents) who are aged 18 years and over. Employees of the Promoters and their immediate families and the suppliers and agencies associated with this competition are ineligible to enter.

3. This competition commences at 6pm AEDT Monday 16 March 2026 and ends at 6am AEDT Monday 30 March 2026 (“Competition Period”). Late, incomplete, incorrectly submitted, delayed, illegible, corrupted or misdirected responses will be deemed invalid. Entrants can only enter in their own name.

4. To enter this competition Eligible Entrants must, during the Competition Period:

a) Sign-up for, and successfully verify a pay.com.au business account during the Promotion Period using sign-up code ENAPELLY (Account Verification);

b) Like & comment on each @enapelly x @payrewards #EPxPAYREWARDS (Promotion Post)

c) Be following both @enapelly and @pay.com.au at the end of the Promotion Period and for at least seven days following the end of the Promotion Period

Completing steps a, b & c above will constitute a valid “Entry”.

Bonus Entry: Eligible entrants who complete the Entry Conditions will also receive an additional entry (Additional Entry) for each Promotion Post shared to the eligible entrant’s own Instagram story during the Promotion Period. (each, an Additional Entry Condition)

5. There will only be one (1) winner. Entrants may only have one entry per Entry and one entry per Additional Entry Conditions (Entrant can only qualify for one (1) Additional Entry per Promotion Post, even where the Promotion Post is shared more than once).

6. The winner will be selected by random electronic number generator drawn on Monday 30 March 2026 at 12:00pm AEDT at 207/28 Riddell Parade, Elsternwick, VIC, 3185 (“Draw Date”)

7. The prize winner will receive:

a) Economy return flights for 2 people to Paris and two business lounge passes, up to the value of AUD$5,000* (Flights Prize) OR (at winner’s election) 625,000 PayRewards Points (PayRewards Points Prize) AND

b) AUD$5,000 Ena Pelly gift voucher (Gift Voucher Prize)

TOTAL COMPETITION PRIZE POOL: $10,000 AUD

8. The winner will be notified within 7 days following the conclusion of the Draw on the Draw Date.

9. Prize Delivery

Flights Prize: Promoter will contact Winner to arrange booking of flights in accordance with Prize conditions below.

PayRewards Prize: Prize will be allocated to Winners’ Pay.com.au within 14 days of the Winner making the election between the Flights Prize and PayRewards Prize.

Gift Voucher Prize: Gift voucher will be emailed to the Winner’s nominated email address within 14 days of the Winner claiming the prize.

10. No part of the prize is exchangeable, redeemable for cash or any other prize or transferable, unless otherwise specified in writing by the Promoter.

11. Flights Prize:

Promoter will contact Winner to arrange booking of flights in accordance with Prize conditions below. Flights prize will be booked by Promoter on Winner’s behalf (Promoter Travel Service).
Promoter Travel Service will be provided subject to such further terms and conditions as reasonably notified by the Promoter to Winner from time to time.
Winner must provide preferred travel dates within next eighteen (18) months (Flight Dates Window). Promoter will have sole discretion over airline.
In the event, the flight booking (including business class lounge passes) on the Winner’s preferred travel dates exceeds the cost of AUD$5,000 – the Winner must either (i) contribute the additional cost or (ii) select alternative dates.
Winner acknowledges and agrees that all flight bookings, including lounge passes, are strictly subject to availability, and the Promoter does not guarantee suitable flights will be available on the Winner’s preferred dates.
Winner acknowledges that Promoter will be unable to secure booking until all necessary information and documents for Winner and travel companion, as reasonably requested by Promoter, are provided to the Promoter.
If a suitable flight booking is unable to be confirmed within three (3) months after the Winner claimed the prize for any reason, the Winner acknowledges and agrees the Winner will instead be allocated the PayRewards Prize.
Once confirmed, flight bookings are non-refundable and cannot be changed.
Winner acknowledges and agrees that any flight booking, including any lounge access, is a service delivered by a third-party and will be subject to the relevant third-party terms and conditions which will be provided to the Winner upon booking confirmation.
In the event of cancellation to a flight booking, in respect of the first cancellation – Promoter will use best efforts to coordinate a new booking with the Winner (subject to the same prize conditions) on similar dates or alternative dates within the Flight Dates Window. In the event of any subsequent cancellation, Winner acknowledges and agrees that the Promoter shall not be obliged to coordinate a new booking and Winner shall be instead be allocated the PayRewards Prize.
Winner shall be solely responsible for any additional costs or arrangements required for travel or activities associated with the travel booking, including visas, ground transports and accommodation.

12. PayRewards Prize:

PayRewards membership, PayRewards Points, and use of the pay.com.au Platform are subject to the PayRewards Terms and Conditions and pay.com.au Platform Terms and Conditions, respectively, each as amended from time to time.
It is the Winner’s responsibility to redeem PayRewards Points for flights or other goods or services.

13. Gift Voucher Prize;

Gift voucher is supplied by Ena Pelly Group Pty Ltd (Ena Pelly).
Gift voucher can be used in store or online.
Gift voucher must be entered at checkout to be applied to online orders.
Gift voucher can be used for one or multiple purchases. Gift card is valid for 3 years from the issue date, and any unused value will not be refunded or credited. Lost or stolen gift vouchers will not be replaced or refunded.
The Promotion is not responsible or liable for any loss, damage or injury suffered by any Winner as arising from, or in connection with the Prize, or the conduct of Ena Pelly.

14. If for any reason the Winner does not claim the Prize, the Prize will remain unclaimed for three months after the Draw Date, an unclaimed Prize draw will be held on 30 June 2026 at 12:00pm AEDT at 207/28 Riddell Parade, Elsternwick, VIC, 3185 (Unclaimed Prize Draw).

15. The last name, initial of the first name of the Winner/s will be published at http://www.pay.com.au for a period of 30 days following the date the Winner/s are notified.

16. To the extent permitted by law (and subject to any directions from a regulatory authority), pay.com.au reserves the right to amend, withdraw or suspend the Promotion, or amend terms and conditions applying to this promotion, at any time without notice, and invalidate any affected entries, or suspend or modify a prize.

17. Any claims in respect of the Promotion, Flights Prize or PayRewards Prize must be made to the legal@pay.com.au. Any claims in relation to the Ena Pelly Gift Voucher Prize must be made directly to Ena Pelly at enquiries@enapelly.com.au

18. Collection, use and disclosure of personal information by pay.com.au will be in accordance with its Privacy Policy.

By completing Account Verification, Eligible Entrants consent to (i) the Promoter sharing their name and email address with Ena Pelly and (ii) receiving marketing communications from Ena Pelly. Ena Pelly’s collection, use and disclosure of personal information will be in accordance with its Privacy Policy.

General Terms

1. By participating, entrants agree to be bound by these terms and conditions. Entries must comply with these terms and conditions to be valid. To the extent permitted by law, Promoter reserves the right to amend these terms and conditions, subject to any directions from a regulatory authority.

2. All costs and expense other than those referred to in the Prize section in the Schedule will be at the Winner’s costs. The promoter will not be liable for the failure of the Winner to use any part of the Prize or to meet travel schedules or cancellations. No cash or other prize will be awarded if any part of the Prize expires for any reason.

3. The Promoter is not liable for any loss, damage or injury suffered (even if caused by negligence) as a result of the Winner/s accepting or using the Prize (or both), except for any liability that cannot be excluded by law.

4. If required by law, the draw will be scrutinised by an independent person, unless an exemption is granted by a regulatory authority.

5. The winners of any Unclaimed Prize Draw will be notified, and their names will be published, in the same manner as set out in the Schedule for winners of the Prize Draw.

6. The Promoter assumes no responsibility for any failure to receive an entry or for inaccurate information or for any loss, damage or injury as a result of technical or telecommunications problems, including security breaches. If such problems arise, the Promoter may (where necessary with the approval of the relevant lottery authority) modify, cancel, terminate or suspend the Promotion.

7. Promoter retains sole discretion in determining verification of pay.com.au accounts.

8. By entering this Promotion, Eligible Entrants license the Promoter to use the content of their entry in any way the Promoter wishes (including modifying, adapting, copying, publishing, broadcasting or communicating the entry whether in original or modified form in whole or in part) in all media in perpetuity without payment or giving other consideration to the Eligible Entrant.

9.By entering this Promotion, Eligible Entrants consents to the Promoter dealing with their entry content in any way that may otherwise infringe the Eligible Entrants' moral rights and agree not to assert their moral rights (wherever such rights are recognised) in respect of their entry against the Promoter or its assigns, licensees or successors.

10. Eligible Entrants warrant that their entry is not in breach of any third-party intellectual property rights.

11. Eligible Entrants consent to the Promoter using their name, likeness, image or voice (or a combination of these, to the extent collected during or in related to the Promotion) in the event that they are a Winner, in any media in perpetuity without remuneration or compensation for the purpose of promoting this Promotion (including any outcome) and/or promoting any products manufactured, distributed or supplied (or both) by the Promoter.

12. These terms and conditions, and the Promotion and any claim or dispute between the Promoter and an Entrant are governed by the laws of Victoria, Australia. In the event of a dispute in relation to the Promotion, Eligible Entrants must contact the Promoter to attempt to resolve the dispute in good faith. If the matter cannot be resolved, Entrants submit to the non-exclusive jurisdiction of courts and tribunals of Victoria in connection with any dispute concerning these terms and conditions and the Promotion.

13. The Promoter accepts no responsibility for late, lost or misdirected entries or other communications. Entries will be deemed void if illegitimate, forged, manipulated or tampered with in any way.

14. By taking any of the actions required to qualify for the Entry Conditions or Additional Entry Condition, on Instagram, Eligible Entrants:

(a) agree to comply with Instagram’s terms of use;

(b) release Instagram from all claims based on, related to or arising from the Promotion; and

(c) acknowledge and agree that this Promotion is in no way sponsored, endorsed, administered by or affiliated with Instagram.

15. The Promoter is not responsible for any loss, damage or injury to Eligible Entrants resulting from entering or participating in this Promotion including arising from any comments made, or material published by third parties about Eligible Entrants on any social media platform in connection with this Promotion.

16. Should an Eligible Entrant’s contact details change during the Promotion Period, it is the Eligible Entrant's responsibility to notify the Promoter. A request to access or modify any information provided as part of the redemption of a Prize should be directed to the Promoter. The Promoter takes no responsibility where it is unable to contact prize winners who have not provided correct or complete contact details.

17. The Promoter reserves the right to request verification of the social media profile of Eligible Entrants and of the age, identity and residential address of the Winner[s] and any other information relevant to entry into or participation in this Promotion. Verification is at the discretion of the Promoter, whose decision is final. Failure by the Promoter to enforce any of its rights does not constitute a waiver of those rights.

18. The Promoter reserves the right to disqualify any individual who submits an entry that is not in accordance with these terms and conditions, or who is involved in any way in interfering or tampering with the conduct of this Promotion, has breached any of these terms and conditions, or engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the Promotion. In the event that a winner breaches these terms and conditions, the winner will forfeit the prize in whole and no substitute will be offered. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.

19. The Winner/s have rights under the Australian Consumer Law and other similar legislation which cannot be excluded, restricted or modified by these terms and conditions. However, to the extent that it is permitted to do so, the Promoter (including its officers, employees and agents) excludes all liability whether arising in tort (including without limitation negligence), contract or otherwise for any personal injury or any other loss or damage (including without limitation loss of opportunity or loss of profits) whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, without limitation, any variation in market value of the Prize stated in these terms and conditions or tax implications association with the Prize, the Prize or use of the Prize.

CREATING AN ACCOUNT

When you access the Website, you may create an online account with us and provide us with personal details. To place an order on the Website, you will need to provide us with personal details. In either case, it is very important that any personal details you provide are complete, true and up to date Please let us know if your personal details change or are recorded incorrectly and we will promptly update them. If you create an online account with us, you will need to create a password to access your online account. Your password must be unique and kept secure and private at all times. Please let us know immediately if you believe or suspect there to have been a breach of security or any unauthorised use of your account.

ORDERS

All orders will be accepted at ENA PELLY’s sole discretion. When you submit an order on the Website, this constitutes your legally binding offer to purchase merchandise. If we accept your order, you will be sent an Order Confirmation email specific to your purchase. If we do not accept your order we will notify you via email. All orders are subject to ENA PELLY's approval and the availability of merchandise. ENA PELLY may place a limit on the quantity of merchandise that can be ordered on the Website.

PRICE

All orders are priced in Australian dollars and include GST.

All prices quoted on the Website exclude postage and handling costs. You will be charged extra for postage and handling. You will be notified of these extra costs at the time you place your order.

STORE CREDITS

Store credits are valid for online use only. These cannot be used in store.

CANCELLATION OF ORDERS

What is Afterpay?

Afterpay offers simple and affordable instalment plans for online shoppers. The payment platform allows you to purchase in four equal instalments, due every fortnight. There is no additional cost to use Afterpay. All of your payments are interest free and you will receive your order in accordance with these terms and conditions.

How does it work?

To make a purchase using Afterpay, you will need:

1. A debit or credit card

2. To be over 18 years of age

3. An Australian residential address

1. At the ENA PELLY checkout, select Afterpay as your payment option. You will then be redirected to the Afterpay website to process your order.

3. Register or login into Afterpay to confirm your order.

4. You will then be redirected to the Ena Pelly website to receive your order confirmation.

5. Please note: Afterpay has a maximum transaction limit of AUD $1000, however each order is subject to Afterpay's credit assessment.

How do I use Afterpay?

When you place your first order with Afterpay, the first instalment will be charged at the time of purchase. Each instalment will then be deduced from your debit/credit card each fortnight. For all of your future orders using Afterpay, your first instalment will be deducted within 14 days. At the time of purchase, the full Afterpay schedule will be outlined for you.

When will my order be shipped?

Your order will be shipped as soon as practicable and in accordance with the terms contained herein. Afterpay only defers the payment, not your new dress!

Can I return my Afterpay order?

We are able to issue returns for orders processed through Afterpay. We will issue a store credit of 110% of the purchased product(s), or offer exchange of size if the order is purchased at full price. Any returned items processed through Afterpay must remain within the 14 day Returns and Exchanges Policy in order to be granted a credit or exchange.

Use of the Website is on an “as is” and “as available” basis.

Use of the Website is at your own risk.

a breach of Australian and/or International intellectual property laws by you.

SEVERANCE

If any part of these Terms and Conditions is found to be invalid or unenforceable, the remainder of the Terms and Conditions will continue to apply.
